General terms and conditions of sale

Item 1: Scope

These general terms and conditions of sale are drawn up between:
The company Delphine Quirin, Rue Pierreuse 26, 4000 LIEGE (Belgium) and all physical persons visiting and/or wishing to make a purchase via the Internet site delphinequirin.be.
The purpose of these terms and conditions is to define the remote sales formalities between delphinequirin.be and the user, from the order to payment and delivery. They govern all the stages necessary for placing the order and enable this order to be monitored between the contract parties.
The user declares:

  • capacity to close this contract,
  • that purchases will not be made with a view to reselling

Item 2: Products

The products offered for sale which are available are those appearing on the site at the moment at which this site is consulted by the user, subject to the extent of the available stock.
The products offered for sale are described as accurately as possible. Nevertheless, should errors or omissions emerge in this presentation, delphinequirin.be shall not be held liable. The photographs and texts illustrating the products are merely a guide and have no contractual value.

Item 3: Prices

Prices are presented in Euro, comprising all taxes including VAT, and excluding delivery charges which remain the responsibility of the user unless specific conditions prevail.
The prices indicated take account of the VAT that applies on the day of the order. delphinequirin.be reserves the right to change its prices at any time. The products will be invoiced based on the rates that are valid at the time the order is taken.
For orders to be dispatched to countries outside the European Union, sales prices as well as mailing costs are understood exclusive of taxes.

Item 4: Detailed indication of the price of goods

The prices of our products are indicated in Euro and only settlements in Euro are accepted.
Payment is requested from the moment of order placement. It can be made in a number of ways:

  • Using your Visa, MasterCard/Eurocard credit card; via Paypal. In this case, the order will be processed once authorisation has been received from Paypal.
  • By manual transfer to our account

The ordered product will not be delivered until payment has been received. For that reason, it is advisable to settle the payment as soon as possible.

An invoice will be generated by the site. The purchaser will need to state the billing address for the invoice.
delphinequirin.be reserves the right to change its prices at any time and without prior notice. Products already ordered will still be invoiced at the rates that were valid at the time the order was taken.
A flash sale is a commercial promotion with the purpose of offering site visitors a reduced price on products put on sale uniquely between an opening date and a closing date.
The sale will be declared over once the closing date has passed.
Customers will no longer be able to order at the price indicated during the time of the flash sale, once this sale is over.
Modification of the contract

  • may be revised
  • may be changed

In any event, the sale will be declared over when the quantity of available products has been exhausted.

Item 5: Delivery and charges

Delivery charges are the responsibility of the purchaser and are added to the price of the ordered product. Products are shipped via the usual postal services or by carrier. delphinequirin.be declines all responsibility in the event of an excessive shipping time caused by the postal services or means of transport, as well as in the event of loss of ordered products or of strikes. Transport risks are borne by the user, who will need to submit the customary requests to the postal services or the carrier.
When we have processed your order and proceeded to parcel dispatch we will will send you the number corresponding to your parcel.
All incurred customs charges are the responsibility of the customer.
In the event of loss or deterioration of the product during transport, the customer must inform the carrier as soon as possible.
In the event of unusual delay, you will receive an e-mail.

Item 6: Returns and exchanges

Necessary conditions for return

Starting from the date his or her order was taken, the customer has a period of 14 days in order to return his/her item(s), with the exception of special orders or made-to-measure items. Once this period has passed, the delivered products will be deemed compliant and accepted by the purchaser. From that moment, delphinequirin.be may reserve the right to refuse exchange or reimbursement.
The returned item must not have been worn, used or washed and must be sent back in its original packaging, accompanied by an explanatory message indicating the order number, the purchaser's full name and address as well as the desired mode of return: "exchange" or "reimbursement". In this case, the customer must return his/her item(s) to the following address (return postal charges remain his/her responsibility):

On receipt, a quality check will be performed on the received merchandise. No item used or spoilt by the customer can form the subject of any request for exchange or reimbursement whatsoever.

Options for returns

  • Exchange for one or a number of other items whose total sales price does not exceed that already paid by the purchaser on his or her initial order (and subject to the stock available on the date the return parcel was received).
  • Reimbursement of the sums paid, which will be performed within a maximum period of 30 days after receipt of the item returned by the customer at delphinequirin.be, excluding shipping costs associated with this return, according to the payment method chosen at the time of ordering.

For returns of orders delivered outside Belgium, only the returned items will be reimbursed.

Item 7: Data privacy

Personal information

As personal information is necessary for the processing, the delivery of orders and the generation of invoices, gathering of this information in the context of remote sales is obligatory. This information is strictly confidential and is addressed solely to the company Delphine Quirin.

Intellectual property

All elements of the site delphinequirin.be, visual and audio, are protected by the rights of the originator of the brand. They are the exclusive property of the company Delphine Quirin.

Item 8: Responsibility

For all stages of access to the site, of the order process, of delivery or of subsequent services, the company delphinequirin.be only has the obligation to provide resources. In conformity with law, the company shall not be held liable for any inconvenience or damage inherent to Internet usage, in particular any interruption in service, external intrusion or the presence of computer viruses, or for any incident deemed to be a force majeure.
Moreover, delphinequirin.be waives its liability for all failures to meet its contractual obligations in the event of force majeure or coincidental incident, including but not limited to strike, fire, natural disaster, breakdown and generally any event obstructing the smooth completion of orders.

Item 9: Acceptance of the general terms and conditions

These general terms and conditions apply to all offers, sales, purchases and other transactions of whatever nature between the parties.
As a result, by the fact of laying claim to and/or using the services of delphinequirin.be, of placing an order and/or closing a contract of any kind, the user irrevocably acknowledges receipt of a copy of these general terms and conditions and that these can be opposed to him/her, and he/she accepts that these terms and conditions apply to the exclusion of all others. The general or specific terms and conditions of the user will never find application, except in the event of express, written and prior agreement by delphinequirin.be
These general terms and conditions of sale can be consulted on the purchase confirmation page. If the user so desires, he/she may download them, print them and keep a copy.
These general terms and conditions are likely to evolve in the future. Users tacitly accept all changes while continuing to use and visit the site delphinequirin.be. They are advised to visit regularly and familiarise themselves with the new general terms and conditions of sale.
delphinequirin.be invites users to acknowledge the general terms and conditions and accept them by checking "I have read the general terms and conditions of sale and I will comply them without reservation." during the order process in order to be able to complete their purchase. On failure to do this, the user will not be able to proceed to payment of his/her purchases.

The fact that the user does not acknowledge the general terms and conditions of delphinequirin.be in his/her native language does not in any way negate the terms' validity. The general terms and conditions are offered in three languages (French, Dutch, English).
Any user wishing to purchase on the site declares full legal capacity to do so.

Item 10: Applicable law and competent courts

These general terms and conditions of sale along with all disputes are governed by Belgian law. The Parties accept submission of all litigations relating to these general terms and conditions to the exclusive competence of the Courts of Liège.
